Terms & Conditions

1. Introduction
Welcome to Whobela (“Whobela,” “we,” “us,” or “our”), a web application that lets users create personalized, interactive invitation pages for the purpose of arranging romantic dates, sharing them via a unique link, and managing responses, bookings, and contact details from the people who view those pages.
These Terms & Conditions (“Terms”) form a binding agreement between you and Whobela. They apply to anyone who creates an account on Whobela (a “User”) as well as anyone who visits, views, or interacts with a page created using Whobela (a “Visitor”), even if that person never creates an account.
Whobela is operated by [Company Legal Entity Name], a company registered at [Company Registered Address] under registration number [Company Registration Number].
By creating an account, accessing whobela.com, or interacting with any page hosted on Whobela, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the platform.
You must be at least 18 years old to create an account or to be the subject of a Whobela page. Whobela is not directed at, and must not be used by, anyone under 18.
2. Account Rules
2.1 Creating an account
To use most features of Whobela, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.
2.2 Accurate information
You agree not to impersonate any person or entity, and not to misrepresent your identity, age, or affiliation with any person or entity. Misrepresentation that could mislead a Visitor about who they are interacting with is a violation of these Terms.
2.3 Password security
You are responsible for maintaining the confidentiality of your account credentials. You must use a strong, unique password and must not share your credentials with anyone else. Notify us immediately at support@whobela.com if you suspect unauthorized access to your account.
2.4 Account responsibility
You are responsible for all activity that occurs under your account, whether or not you personally performed it, except to the extent that activity results from our failure to secure the platform.
2.5 Suspension and termination
We may suspend, restrict, or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or our Community Guidelines, or if your use of the platform creates risk or legal exposure for Whobela or other users.
3. Platform Usage Rules
You agree to use Whobela only for lawful purposes and in a manner consistent with these Terms. Without limiting the foregoing, you must not:
- Harass, threaten, stalk, or abuse another person through any page, message, or feature on Whobela;
- Create a fake identity, impersonate another real or fictional person, or misrepresent your relationship to another person;
- Use Whobela to facilitate, promote, or conceal illegal activity, including trafficking, exploitation, or solicitation prohibited by law;
- Upload, share, or link to content that is unlawful, sexually exploitative of minors, violent, hateful, or otherwise harmful;
- Send spam, unsolicited bulk messages, or use Whobela for mass, automated outreach unrelated to a genuine personal invitation;
- Manipulate, scrape, reverse-engineer, or interfere with the platform, including attempts to bypass rate limits, security controls, or paywalls;
- Attempt to gain unauthorized access to another user's account, data, or non-public areas of the platform.
Violations may result in content removal, account suspension, termination, and, where required by law, a report to the relevant authorities.
4. User Content
4.1 Ownership
You retain ownership of the content you upload or create using Whobela, including photos, profile information, invitation page text, and custom page designs (“User Content”). We do not claim ownership over your User Content.
4.2 License to operate the service
By uploading or creating User Content, you grant Whobela a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt (for example, to resize images or render your page on different devices), and display that User Content for the purpose of operating, providing, and improving the service — including delivering your invitation page to the Visitors you choose to share it with. This license ends when you delete the relevant content or your account, subject to our data retention practices described in the Privacy Policy.
4.3 Your responsibility for content
You are solely responsible for the content you upload. You confirm that you have the rights necessary to upload it, that it does not infringe a third party's rights, and that it complies with these Terms and our Community Guidelines.
5. Public Pages
Invitation pages you create are intended to be shared with specific people via a unique link. You understand and agree that:
- Anyone who receives or guesses your unique link may be able to view the page and the information on it, unless you have enabled available privacy controls;
- You are responsible for deciding who you share your link with and for understanding the consequences of sharing personal or romantic content publicly or semi-publicly;
- Whobela provides privacy settings (where available) to help you control visibility and access, and you should review and configure them before sharing a page;
- Whobela is not responsible for what a Visitor does with a link or information after you have shared it with them.
6. Dating / Relationship Disclaimer
Whobela provides technology that helps you design, send, and manage invitation pages. We are a software platform, not a matchmaking, dating, or relationship service, and we do not vet, verify, or background-check Users or Visitors.
We make no guarantee, representation, or warranty regarding:
- Whether a Visitor will respond, accept, or engage with your invitation;
- The outcome of any date, conversation, or relationship arising from use of the platform;
- The identity, intentions, safety, or honesty of any User or Visitor;
- The accuracy of information that a User or Visitor provides about themselves.
You acknowledge that interactions facilitated through Whobela carry inherent personal risk, and that Whobela's role is limited to providing the technology used to create and share invitation pages.
7. User Safety
Your safety is your responsibility when meeting or communicating with people through Whobela. We strongly recommend that you:
- Meet in public places for initial in-person meetings and tell a trusted friend or family member your plans;
- Avoid sharing sensitive personal information (such as your home address, financial details, or government identification) until you have established trust;
- Use your own judgment about who to engage with and trust your instincts if something feels wrong;
- Report any suspicious, abusive, or unsafe behavior through our reporting tools or by emailing support@whobela.com.
See our Safety Policy for more detailed guidance.
8. Payments
8.1 Subscriptions
Certain features of Whobela require a paid subscription. By subscribing, you authorize us (through our payment processors) to charge your chosen payment method on a recurring basis according to the billing cycle you select.
8.2 Payment processors
Payments are processed by Stripe and/or PayPal. We do not store your full payment card details. Your use of these payment methods is also subject to Stripe's and PayPal's own terms and privacy policies.
8.3 Renewal and cancellation
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period unless otherwise stated.
8.4 Refunds
Refunds are handled in accordance with our Refund Policy.
9. Premium Features
Premium subscriptions may unlock features such as publishing additional pages, connecting a custom domain, removing Whobela branding from your pages, advanced analytics, or other paid features described at the time of purchase. Availability of specific features may change as the product evolves; we will make reasonable efforts to communicate material changes to paid features in advance.
10. Intellectual Property
Whobela's name, logo, branding, software, platform design, and underlying technology are the property of [Company Legal Entity Name] or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted to you to use the platform, nothing in these Terms transfers any intellectual property rights to you. You may not copy, modify, distribute, or create derivative works of Whobela's platform, branding, or software without our prior written consent.
11. Termination
You may delete your account at any time through your account settings or by contacting support@whobela.com; see our Delete Account page for details.
We may suspend or terminate your account or access to the platform, with or without notice, if you violate these Terms, if required by law, or if we discontinue the service in whole or in part. Upon termination, your right to use the platform ends immediately; certain provisions of these Terms (including Sections 4, 6, 10, 11, and 12) survive termination.
12. Liability Limitations
To the fullest extent permitted by applicable law:
- Whobela is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement;
- Whobela will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from your use of, or inability to use, the platform;
- Whobela's total aggregate liability for any claim arising from these Terms or your use of the platform will not exceed the greater of (a) the amount you paid to Whobela in the 12 months preceding the claim, or (b) USD $100.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death, personal injury, fraud, or gross negligence where such limitation is not permitted.
13. Governing Law
These Terms are governed by the laws of [Governing Jurisdiction], without regard to conflict-of-laws principles, except where mandatory consumer-protection laws of your country of residence grant you additional rights that cannot be waived — in which case those mandatory local protections will apply alongside these Terms. Any dispute arising from these Terms will be subject to the courts of [Governing Jurisdiction], unless applicable law requires otherwise.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the platform before the changes take effect. Continued use of Whobela after changes take effect constitutes acceptance of the revised Terms.
